Terms of Service

1. Agreement

By accessing or using GlobMaps ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation. If you do not agree, do not use the Service.

2. Description of Service

GlobMaps provides climate intelligence APIs, geospatial risk scoring, flood, wildfire, drought, and environmental monitoring data products accessible via web dashboard and REST API. Features and availability may change over time with reasonable notice.

3. Accounts & Registration

You must provide accurate registration information and keep it updated. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at support@globmaps.com if you suspect unauthorised access.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with our Acceptable Use Policy. You must not use the Service to violate any applicable law, infringe third-party rights, transmit malicious code, attempt to gain unauthorised access to our systems, or build a competing climate data API platform without our written consent.

5. API Access & Quotas

Your subscription tier defines your monthly request quota and rate limits. Exceeding your quota may result in throttling or temporary suspension. You must not share API keys publicly or across unrelated organisations. GlobMaps reserves the right to suspend access for abuse or terms violations.

6. Subscriptions & Billing

Paid subscriptions are billed in advance on a monthly or annual basis via Stripe. All fees are non-refundable except where required by law or expressly stated in writing. We may change pricing with 30 days notice. Failure to pay may result in service suspension. You are responsible for all taxes applicable in your jurisdiction.

7. Free Tier & Trial

Free tier access is provided without warranty and may be modified or discontinued at any time. We reserve the right to limit or terminate free tier access for excessive usage or abuse.

8. Intellectual Property

GlobMaps retains all rights to the platform, APIs, models, and underlying data. We grant you a limited, non-exclusive, non-transferable licence to access and use the Service during your subscription for your internal or commercial purposes. You retain ownership of any data or content you submit to the platform.

9. Data, Privacy & Retention

Your use of the Service is subject to our Privacy Policy. Data retention periods: (a) Account data (email, preferences, product type) — retained for the lifetime of the account and deleted within 30 days of account closure; (b) API query logs (country, timestamp, anonymised request metadata) — retained for 90 days for billing audit purposes, then permanently deleted; (c) API keys — stored in hashed form and purged within 90 days of revocation; (d) Billing and payment data — governed by Stripe's data retention policies (typically 7 years for financial compliance). Right to erasure: users may request deletion of personal data by contacting legal@globmaps.com. GlobMaps will fulfil verified erasure requests within 30 days, except where retention is required for legal or regulatory compliance. For business customers requiring a Data Processing Agreement (DPA) under GDPR, PDPA, or equivalent regulations, please contact legal@globmaps.com.

10. Third-Party Services

The Service integrates data from third-party sources including satellite providers, government agencies, and open datasets. We are not responsible for the accuracy, availability, or continuity of third-party data. Third-party services are governed by their own terms.

10a. Country-Specific Data Limitations — Vietnam

Vietnam province data: (1) Administrative boundaries — Data uses GADM-4.1 boundaries (ISO 3166-2:VN as of November 2020). Vietnam's administrative restructuring effective July 1, 2025 (Resolution 202/2025/QH15) consolidated provincial units from 63 to 34. GlobMaps will update boundaries upon formal adoption by ISO and GADM. Time-series analyses spanning July 1, 2025 should account for potential boundary discontinuity; GlobMaps accepts no liability for analytical errors arising from such discontinuity. (2) ERA5 precipitation bias — ERA5 reanalysis systematically overestimates precipitation in Vietnam by approximately 28% relative to NOAA GHCND ground-station measurements, which may cause SPEI-derived drought indices to understate drought severity during rainfall-deficit periods. GlobMaps compensates for this bias through MDI (Multi-index Drought Indicator) v2.2, incorporating MODIS Vegetation Condition Index and soil moisture layers; however, residual bias may persist and actual drought conditions may differ from model output. (3) Operational use limitations — Vietnam drought data is provided for analytical and decision-support purposes only. Users must not rely solely on GlobMaps data for decisions affecting human safety, food security, agricultural insurance payouts, or emergency response. Cross-referencing with official data from the National Centre for Hydro-Meteorological Forecasting (NCHMF) is strongly recommended for any operational or high-stakes use. GlobMaps' liability with respect to decisions based on Vietnam provincial data is limited as set out in Section 12.

10b. API Usage Terms — Drought Research API (B2B)

The following terms apply to enterprise and B2B access to the Drought Research API (X-API-Key authenticated endpoints): (1) Permitted use — API access is granted solely for the subscriber's internal analytical and decision-support purposes. Subscribers must not redistribute, resell, sublicense, or create derivative data products from GlobMaps API output without express written consent. (2) Data accuracy disclaimer — MDI output is a probabilistic decision-support tool and does not constitute official government meteorological data. Subscribers are solely responsible for any decisions, financial commitments, or operational actions taken based on API output. (3) Rate limits and quota — GlobMaps reserves the right to adjust rate limits and monthly call quotas by tier with at least 30 days' written notice, except in cases of abuse or system integrity risk where immediate adjustment may be applied. (4) Service level — GlobMaps targets 99.5% monthly uptime for API endpoints. In the event of uptime falling below this threshold, subscribers on paid API plans may request a pro-rata service credit by contacting support@globmaps.com within 14 days of the incident. Credits are the sole remedy for SLA breach; GlobMaps is not liable for consequential losses arising from API unavailability. (5) API key security — Subscribers are responsible for securing API keys. Keys must not be embedded in public repositories, client-side code, or shared across unrelated organisations. Suspected key compromise must be reported immediately; GlobMaps will revoke and reissue affected keys upon confirmed breach.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL BE ACCURATE OR COMPLETE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLOBMAPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE FEES YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold GlobMaps harmless from any claims, losses, damages, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

14. Termination

Either party may terminate at any time. You may cancel your subscription via the billing portal. We may suspend or terminate your access immediately for material breach of these Terms, illegal activity, or non-payment. Upon termination, your right to access the Service ceases and we may delete your data subject to our retention schedule.

15. Governing Law

These Terms are governed by the laws of Thailand. Disputes shall be resolved in the courts of Thailand, except where mandatory local law requires otherwise.

16. Changes to Terms

We may update these Terms periodically. For material changes, we will notify registered users by email at least 14 days before the change takes effect. Continued use after the effective date constitutes acceptance.
